Welcome to the April 2026 edition of the Regulatory Insights Newsletter!

On 16 April, the LMA submitted its response to the European Commission’s consultation on the competitiveness of the EU banking sector, highlighting the importance of diversified credit intermediation in supporting banks’ balance‑sheet capacity and financing the real economy.

Our response calls for:

  • proportionate and consistent implementation of Article 21c of CRD VI to preserve EU borrowers’ access to cross‑border lending
  • targeted reforms to securitisation to enable effective balance‑sheet recycling
  • a more risk‑sensitive application of the EBA’s leveraged loan guidance
  • EU‑level clarification on UCITS eligible assets to prevent national gold‑plating, and
  • a more proportionate calibration of the non‑performing loan backstop to avoid unnecessary constraints on bank lending

Taken together, these recommendations aim to strengthen EU banks’ competitiveness while supporting efficient, scalable financing of Europe’s strategic investment needs. Thank you to the many members who contributed to this wide-ranging and important submission.

LMA Regulatory Scanner

The April edition of the ​LMA Regulatory Scanner​ is now available to members. This edition highlights key updates and upcoming changes impacting the loan markets – including Article 21c of CRD VI, securitisation, private credit, sustainable finance, and more.

Advocacy and Engagement

  • On 16 April, we published our response to the EC’s consultation on the competitiveness of the EU banking sector
  • We are preparing a response to the FCA‘s and PRA’s consultation on securitisation (deadline 18 May)
  • We are closely engaged on securitisation developments, including monitoring discussions in the European Parliament ahead of the ECON Committee vote scheduled for 5 May
  • We are continuing our advocacy on the Sustainable Finance Disclosure Regulation, engaging with key stakeholders across the Council and European Parliament to share technical input from the market
  • On 11 March, we submitted a joint comment letter (with ISDA, GFXD, and UK Finance) on HM Treasury’s consultation on the UK’s future benchmark regime

Education and Collaboration

  • On 18 June, we will hold our next Member Briefing Call on Public Policy & Regulatory Developments, registration details will be shared in our next regulatory newsletter – stay tuned
  • On 30 April, we will host our Regulatory Evening Seminar & Networking Drinks in Brussels from 16:00 to 20:00 CET – ​register here​
  • On 28 April, we will host a roundtable with Elvinger Hoss on Luxembourg’s approach to Article 21c of CRD VI (in particular, the impact on non-EU bank lending to Luxembourg-based funds and SPVs and the continued availability of “characteristic performance”) – contact ​Odelia Loke​ to register
  • On 16 April, we hosted our regular Member Briefing Call on Public Policy & Regulatory Developments where we covered the latest on EU strategy and geopolitics, EU banks’ competitiveness, and EU and UK securitisation reforms
  • On 14 April, we hosted a roundtable with the FCA focusing on the regulatory framework for AI and digital assets

Jesse joined the LMA as a consultant to support its regulatory and policy work. He brings extensive experience in cross-border financial regulation, particularly navigating the complex interplay of EU, UK, and US rules. Jesse began his career at Allen & Overy LLP and most recently led the financial services regulatory legal team at HSBC Bank plc. He holds a Juris Doctor from Duke University School of Law.

Evelien has extensive experience in EU regulatory and public affairs, having worked across both the public and private sector. After starting her career at Dutch law firm Loyens & Loeff, she moved to Brussels in 2014 to work in the European Parliament for Dutch MEP Cora van Nieuwenhuizen (ECON). Subsequent roles include positions at the Federation of Dutch Pension Funds, ABN AMRO Bank, and Bank of America. Evelien holds degrees in Public Administration and Tax Law from Erasmus University Rotterdam.
